Misdemeanor Convictions Expungement

Persons with misdemeanor convictions are eligible to petition the court for expungement five (5) years after the date of conviction. You may seek expungement of conviction records before the waiting period has elapsed if the prosecutor consents in writing. Note that to obtain expungement of a misdemeanor conviction you cannot have a current or pending driver's license suspension

Felony Convictions Expungement

Those with D felony convictions for acts that did not result in bodily injury to a person must wait eight (8) years after the date of conviction before filing a petition for expungement of conviction records. A person may seek expungement of conviction records before the waiting period has elapsed if the prosecutor consents in writing. Note that to obtain expungement of a felony conviction you cannot have an existing or pending driver’s license suspension.

Other Felony Convictions:

A person may be eligible for expungement of his or her criminal records. The waiting period following completion of sentence will be either eight (8) or ten (10) years depending upon the type of felony conviction. You may be required to obtain the written consent of the prosecuting attorney before the Court may grant the petition for expungement.
